In consideration of participating in axe throwing activities ("Activity") provided by One Axe Shot Inc. ("Company"), I, the undersigned participant ("Participant"), agree to the following terms and conditions:

1. Age Requirement:    

•  I hereby certify that I am at least 18 years of age.

• Individuals under the age of 18 are strictly prohibited from using axes or entering any trailer or designated area where axes are in use.

• Minors may be present in non-restricted areas only if accompanied by a parent or legal guardian at all times.

a- Minor Age: (If signing on behalf of a minor):

• I acknowledge that axe throwing is an inherently hazardous activity that carries the risk of serious injury or death.

• By signing below, I voluntarily assume all risks associated with participation in this activity, both for myself and for the minor named herein.

• I hereby release and hold harmless One Axe Shot Inc., its owners, employees, agents, and affiliates from any and all liability for personal injury, death, or property damage arising from participation in axe throwing activities.

• I understand that failure to sign this waiver will result in denial of participation.

2. Assumption of Risk:

• I understand that axe throwing involves inherent and unpredictable risks, which may result in physical injuries, disability, paralysis, or death.

• I voluntarily accept and assume all such risks, whether foreseeable or unforeseeable.

3. Release of Liability: (To the fullest extent permitted by law):

• I release and discharge One Axe Shot Inc., and its affiliates, officers, agents, employees, contractors, and volunteers (“Released Parties”) from any and all claims, liabilities, or damages arising out of my participation—including negligence.

4. Indemnification:

• I agree to indemnify and hold harmless the Released Parties against any claims, losses, damages, or legal costs (including attorney’s fees) related to my participation or breach of this waiver.

5. Medical Treatment: 

• I consent to emergency first aid and medical treatment if required.

• I understand that the Company does not provide medical coverage and that I am responsible for any medical expenses incurred.

6. Compliance with Rules: 

• I agree to follow all rules and instructions issued by the Company.

• Noncompliance may result in immediate removal from the Activity.

7. Right to Refuse Service: 

  a- The Company reserves the right to refuse service to anyone, including but not limited to individuals:

• Under the influence of alcohol or drugs

• Dressed inappropriately

• Behaving in a disruptive or unsafe manner

8. Governing Law: 

• This waiver is governed by the laws of California, and any disputes will be resolved in the courts of San Diego County.

9. Severability: 

• If any provision of this waiver is held invalid, the remaining terms shall remain in effect.

10.  Image usage rights and permissions: 

• I grant the Company permission to capture and use my image in any promotional media.

• I waive any right to inspect or approve the final use and release the Company from liability regarding the use.

11. Acknowledgment of Understanding: 

• I confirm that I’ve read this document in full.

• I understand and voluntarily accept its terms, including waiver of legal rights and assumption of risk.
